{"id":2243,"date":"2026-09-23T10:05:24","date_gmt":"2026-09-23T14:05:24","guid":{"rendered":"https:\/\/amitytownshippa.com\/wp2\/?p=2243"},"modified":"2026-09-23T10:05:24","modified_gmt":"2026-09-23T14:05:24","slug":"board-of-supervisors-invoke-curative-amendment-six-6-month-data-center-freeze","status":"publish","type":"post","link":"https:\/\/amitytownshippa.com\/wp2\/board-of-supervisors-invoke-curative-amendment-six-6-month-data-center-freeze\/","title":{"rendered":"Board of Supervisors invoke Curative Amendment &#8211; Six (6) month Data Center Freeze"},"content":{"rendered":"<div class=\"wpb-content-wrapper\" id=\"wpb-content-root\"><p>[vc_row][vc_column][vc_column_text]<strong>NOTICE OF ADOPTION OF RESOLUTION INITIATING A MUNICIPAL CURATIVE AMENDMENT TO THE AMITY TOWNSHIP ZONING ORDINANCE<br \/>\n<\/strong><strong>AMITY TOWNSHIP, BERKS COUNTY, PENNSYLVANIA<\/strong><\/p>\n<p>NOTICE IS HEREBY GIVEN that the Board of Supervisors of Amity Township, Berks County, Pennsylvania (the &#8220;Township&#8221;), at a duly convened public meeting held on September 16, 2026, adopted Resolution No. 26-19 (the &#8220;Resolution&#8221;) initiating a municipal curative amendment to the Amity Township Zoning Ordinance pursuant to Section 609.1 of the Pennsylvania Municipalities Planning Code, Act of July 31, 1968, P.L. 805, as amended, 53 P.S. \u00a7 10609.1.<\/p>\n<p><strong><u>PURPOSE OF THE CURATIVE AMENDMENT<\/u><\/strong><\/p>\n<p>The Board of Supervisors has determined that the existing Zoning Ordinance is defective in that it fails to provide for data center uses, defined as including facilities used for housing, operating, and maintaining computer servers, data storage systems, networking equipment, power systems, and cooling infrastructure for the processing, storage, and transmission of electronic data, within any zoning district of the Township. The Resolution initiates a curative amendment process to study and establish appropriate zoning provisions governing data center uses, including suitable zoning district locations, use-specific standards, performance criteria, and related regulations.<\/p>\n<p><strong><u>STAY OF PROCEEDINGS<\/u><\/strong><\/p>\n<p>Pursuant to Section 609.2(3) of the Municipalities Planning Code, 53 P.S. \u00a7 10609.2(3), the adoption of the Resolution imposes a STAY OF ALL PROCEEDINGS on any application for approval of land development, subdivision, or any zoning or building permit for any use that would constitute a data center, as described above. This stay is effective as of September 17, 2026, and shall remain in effect for a period not to exceed one hundred eighty (180) days from that date, or until the curative amendment is adopted or rejected by the Board of Supervisors, whichever occurs first.<\/p>\n<p>Applications subject to the stay include, without limitation:<\/p>\n<ul>\n<li>applications for zoning or building permits for data center construction, expansion, or conversion;<\/li>\n<li>applications for land development or subdivision approval for development that includes data center uses; and<\/li>\n<li>zoning applications for variances, conditional uses, special exceptions, requests for interpretation or appeals related to data center uses.<\/li>\n<\/ul>\n<p><strong><u>INSPECTION OF RESOLUTION<\/u><\/strong><\/p>\n<p>The full text of Resolution No. <u>26-19<\/u> is available for public inspection during regular business hours at the Amity Township Municipal Office, located at 2004 Weavertown Road, Douglassville, Pennsylvania 19518.
